These Terms & Conditions govern your access to and use of the Sublime Pools website and the purchase of products from us. By accessing this website, placing an order, or using any of our services, you agree to be bound by these Terms & Conditions, together with our Shipping & Returns Policy and Privacy Policy.
1. About us
1.1. This website is operated by Sublime Pools (“we”, “us”, “our”). Our business is located in Bulli, New South Wales, Australia.

1.3. To the extent of any inconsistency between these Website Terms and a signed Installation Contract or Supply Agreement, the terms of the signed contract shall prevail.

2.1. You must use this website only for lawful purposes and in accordance with these Terms & Conditions.

3. Product information
3.1. We aim to ensure that product descriptions, images, specifications, availability, and pricing are accurate and up to date. However, errors, omissions, and changes may occur.
3.2. Product images are for illustration purposes only and may not perfectly represent the final product. Colours, dimensions, finishes, packaging, and specifications may vary slightly depending on the manufacturer or supplier.
3.3. Where products are supplied by third parties, we rely on information provided by those suppliers and manufacturers. We do not guarantee that supplier information will always be free from error.
4. Pricing
4.1. All prices are in Australian dollars unless stated otherwise. GST will be shown where applicable.
4.2. We may change prices, product offers, and promotions at any time without notice. A price change will not affect an order that has already been accepted by us.
4.3. If a product is displayed at an incorrect price due to typographical, supplier, system, or publishing error, we reserve the right to cancel the order, decline to proceed, or contact you to confirm the corrected price.
4.4. Any shipping charges, freight surcharges, special handling charges, or delivery-related costs will be shown where applicable or communicated before dispatch.
5. Orders and acceptance
5.1. When you place an order, you are making an offer to purchase the products selected in your cart.
5.2. An order is not accepted until we have confirmed it, processed payment, and/or commenced fulfilment. We may refuse, cancel, or limit any order at our discretion for reasons including product unavailability, pricing errors, or delivery restrictions.
5.3. If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled items.
5.4. Pool Shell & Pre-cast Orders: Notwithstanding the above, a contract for the supply or installation of a Fibreglass Shell or Pre-cast Concrete pool is only formed upon the signing of a formal Agreement and the payment of the required deposit. These items are project-based and cannot be purchased directly through the website checkout. Quotations for these projects are valid for 30 days unless otherwise stated.
6. Payment
6.1. Payment is required in full at the time of order unless we agree otherwise in writing.
6.2. We may use third-party payment providers to process your payment. By submitting payment, you agree to comply with the terms and conditions of those providers.
6.3. You must ensure that all payment details submitted are accurate, valid, and authorised for use.
7. Shipping, delivery, and risk
7.1. Shipping and delivery are governed by our Shipping & Returns Policy, which forms part of these Terms & Conditions.
7.2. Delivery timeframes are estimates only and are not guaranteed.
7.3. You are responsible for providing a complete and accurate delivery address. We are not liable for delivery delays or failed delivery resulting from incorrect or inaccessible delivery details.
7.4. Risk in the products passes to you when the products are delivered to the address supplied or collected by you.
7.5. Title in the products remains with us until we receive payment in full, to the extent permitted by law.
8. Freight-heavy, bulky, and special order items
8.1. Some products may be freight-heavy, bulky, special order, or subject to restricted delivery conditions.
8.2. These products may require specific delivery conditions or mechanical assistance (such as a tail-lift vehicle). The choice of delivery vehicle and unloading method is at the discretion of the freight carrier and/or supplier based on the item’s weight and dimensions.
8.3. Special conditions will be stated on the product page, in the checkout, or communicated directly before dispatch.
9. Supplier-direct fulfilment
9.1. Some orders may be fulfilled by our suppliers or logistics partners.
9.2. Orders containing multiple supplier brands may arrive in separate shipments.
9.3. We are not responsible for delays caused by third-party suppliers or freight carriers, except to the extent required by law.
10. Returns, refunds, and exchanges
10.1. Returns and refunds are governed by our Shipping & Returns Policy and applicable Australian Consumer Law.
10.2. Change-of-mind returns are not automatic. We may refuse a return if the item has been used, installed, modified, or if it was a special order/freight-sensitive item.
10.3. Where a return is accepted for change of mind, the customer may be required to pay return freight and restocking charges.
11. Warranties and consumer guarantees
11.1. Our products may come with manufacturer warranties in addition to your rights under Australian Consumer Law.
11.2. Warranty claims may need to be assessed by us, the manufacturer, or both, depending on the product and the nature of the issue.
12. Installations and advice
12.1. Any installation information, product recommendations, or guidance provided by us is general in nature unless expressly stated otherwise in writing.
12.2. For Supply Only orders, you are responsible for ensuring that any product is suitable for your site conditions, plumbing, electrical requirements, and compliance obligations.
12.3. Where products require professional installation or licensing, you must arrange this through suitably qualified persons.
12.4. Where we are contracted to perform installation services, those works are subject to a separate signed Installation Contract and the requirements of the Home Building Act NSW.
12.5. Communication and Informal Advice: Any advice provided via website chat, email, phone, or social media is general in nature. We are not liable for loss or damage resulting from reliance on such informal advice; the Customer must verify all technical specifications with a licensed professional prior to purchase.
12.6. For on-site services, the Customer must provide clear, safe, and legal access to the Site. If a service is delayed due to site obstructions, the Customer will be liable for all associated labor call-out or equipment standby fees.
13. Intellectual property
13.1. All content on this website is owned by or licensed to us. You must not copy, reproduce, or commercially exploit any content without our prior written permission.
14. Third-party links and services
14.1. Our website may include links to third-party platforms or supplier sites. We do not control and are not responsible for the content or practices of these third parties.
15. Limitation of liability
